PLEASE READ THE FOLLOWING CAREFULLY. You will be required to agree to all that follows, before we can start on a Web site/project for you.

There will be NO refunds on design,programming or marketing services. Any unused hosting time will be refunded upon the cancelation of service by either the consumer or CyberSmartz.

All invoices for services such as monthly maintnance, are due in 10 days of receipt, NO EXCEPTIONS!

Web site design/project fee's are due 40% down and 60% upon completion.

All content you want CyberSmartz to place on your Page/Site must be recieved in 7 business days in electronic format(MS Word/Works/Office or plain text files, .jpg or .gif files either on diskette or via e-mail).CyberSmartz will charge $60.00 per hour to convert any non-digital content into digital format.

Site updates will be billed at $25.00 per hour, unless you sign a min. 18 month. contract($35.00 per month.), you then will receive 2 free hours per month and billed at $15.00 per hour there after. Site updates include the updating of links, images, prices and contact information. It does not include the restructuring, redesigning, or rebuilding of your web page/site, this will all be done at additional charges to the consumer. CyberSmartz reserves the right to determine what is coverered by standard updates and what will be done at additional charges. CyberSmartz also reserves the right to change what is covered at anytime!

CyberSmartz assumes no liability or responsibility for any false or misleading information contained on the Web Page/Site or from any transactions/losses resulting from the Web Page/Site. We also assume no liability in the event of service disruption,Internet problems or connectivity issues.There are NO REFUNDS for these unforseen problems.

An administrative fee of $250.00 will be imposed to reinstate any account or service that was suspended due to non-payment of the final invoice(60%) OR failure to abide by the Acceptable Use Policy.

CyberSmartz reserves the right to refuse/withhold service and or void agreements if the customer does not make timely payments and/or customer acts in a non-professional manner as outlined in our Acceptable Use Policy.

The internet is intended for use by mature adults(minors too when properly supervised). Our customers are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights or other internet users. The customer is expected to have a basic knowledge of how the Internet fuctions, the types of use which are generally acceptable, and the types of use which are to be avoided.

Common sense is the best guide as to what is considered acceptable use. The following uses are unacceptable: Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking any obscene material, drug dealing, and any other illegal activities not metioned above.

Net abuse, including but not limited to activities such as using a non-exsistent e-mail return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous e-mail addresses or newsgroups and/or generating a significantly higher volume of outgoing e-mail than a normal user), allowing spamming by third parties to promote a web Page/Site hosted by CyberSmartz, trolling (posting outrageous messages to generate numerous responses), mailbombing(sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, using abusive or threatening language in any e-mails sent, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system.

Tortuous conduct, including but not limited to posting of defamatory, scandalous, or private informationabout a person/persons without his/her consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Misuse of system resources, including but not limited to employing posts or programs which consume excessive CPU time or storage space, permitting use of mail services, mail forwarding capabilities, POP accounts, or autoresponders other than for the customer's own account, resale of access to CGI scripts installed on CyberSmartz servers, or attemping to use a single customer account for third party web sites by allowing more than one domain pointer to be used to reference pages within the customer's Page/Site.

If you send unsolicited mail, we will notify the proper authorities and your account will be terminated.

Any violation of the above stated acceptable uses and policies will result in immediate termination of service, immediate invoice for services rendered to that date, NO REFUNDS, NO EXCEPTIONS!

CyberSmartz reserves the right to determine what constitutes net abuse.
